These Terms of Service ("Terms") govern your access to and use of Catacysm.com (the "Site") and any purchase you make through the Site. Catacysm is operated by ARIANNY LOPEZ PENA as a sole proprietor (referred to in these Terms as "Catacysm," "we," "us," or "our"). These Terms form an agreement between you and ARIANNY LOPEZ PENA, operating under the Catacysm brand.
By accessing the Site, creating a customer account, or placing an order, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the Site or place an order. Nothing in these Terms limits any consumer right or remedy that cannot lawfully be waived.
1. About Catacysm
Catacysm is an independently operated online formalwear store serving customers in the United States. We currently sell and ship only within the United States.
2. Eligibility and Customer Accounts
You must be able to enter into a legally binding contract to place an order. If you are under the age of majority in your state, a parent or legal guardian must place the order or supervise your use of the Site.
If you create a customer account, you are responsible for providing accurate information, protecting your login credentials, and promptly notifying us of suspected unauthorized access. You are responsible for activity conducted through your account unless caused by our failure to use reasonable care. We may restrict or close an account used for fraud, unlawful conduct, security abuse, or a material violation of these Terms.
3. Product Information, Images, and Sizing
We make reasonable efforts to describe products accurately, including their color, material, features, size options, and availability. Screen settings, lighting, fabric dye lots, hand-finishing, and normal production tolerances may cause minor differences between an image and the delivered product. Product-specific descriptions and measurements take priority over general guides.
Formalwear fit varies by style, fabric, and construction. Customers are responsible for reviewing the product description and size information before ordering. Alterations may be needed for a personalized fit. A minor color or measurement variation disclosed on the product page or within reasonable production tolerance is not automatically a defect, but this does not affect remedies for an item that is damaged, defective, incorrect, or materially different from its description.
We may correct product information, update a listing, or discontinue a product. If a material correction affects an order already placed, we will contact you when reasonably necessary and provide an appropriate option, including cancellation and refund where required.
4. Prices, Currency, Taxes, and Promotions
Prices are displayed in U.S. dollars unless clearly stated otherwise. The price and any applicable sales tax shown at checkout apply to the order. Standard shipping within the eligible U.S. delivery area is currently free with no minimum purchase threshold, as described in our Shipping Policy.
Prices, promotions, discount codes, and product availability may change before an order is submitted. Promotions may have separate eligibility dates or conditions and may not be combined unless expressly stated. If a price or promotion is clearly incorrect because of a typographical, technical, or system error, we may contact you to confirm the corrected price or cancel the affected item and refund any amount charged, subject to applicable law.
5. Orders and Order Acceptance
Your order is an offer to purchase the products listed in the order. An automated order confirmation acknowledges that we received the order; it does not by itself guarantee acceptance, availability, or shipment. We accept an order when we send a shipment confirmation or otherwise expressly confirm acceptance.
We may decline or cancel an order before acceptance for reasons including unavailable inventory, an inaccurate listing or price, an unsuccessful payment authorization, suspected fraud or unauthorized activity, an incomplete or invalid shipping address, shipping restrictions, or a violation of these Terms. We may also limit quantities reasonably associated with resale or commercial redistribution. If we cancel an order after payment was captured, we will refund the canceled amount to the original payment method.
Customer cancellation and change requests are governed by our Return & Refund Policy. A request is not effective until Catacysm confirms it. Custom-size, personalized, altered, made-to-order, and preorder items may not be canceled after production or processing begins.
6. Payment
You may use the payment methods displayed at checkout. By submitting payment information, you represent that you are authorized to use the selected method and authorize the payment processor to charge the total displayed at checkout. Payment processing is provided by third-party payment services under their own terms and privacy practices.
We may request reasonable verification when needed to prevent fraud or confirm an order. We do not directly store full payment-card numbers or card security codes.
7. Processing, Shipping, Tracking, and Delivery
Ready-to-ship items are normally processed within 1–3 business days after payment and order verification. Made-to-order, custom-size, personalized, altered, and preorder items require additional processing or production time as disclosed on the product page, at checkout, or in the order confirmation.
Orders ship from DeLand, Florida through UPS. Estimated transit time after shipment is 3–7 business days. Processing time and transit time are separate, and delivery dates are estimates rather than guarantees. Tracking information is made available through the store's order-tracking link when an order ships.
Customers must provide a complete and accurate delivery address. Contact us immediately if you find an error. We cannot change an address after shipment. Delays, address errors, lost or damaged packages, packages marked delivered, refused shipments, and returned-to-sender packages are handled under our Shipping Policy.
8. Returns, Refunds, and Exchanges
Returns, damaged or incorrect items, non-returnable products, return shipping costs, refund timing, and cancellation requests are governed by our Return & Refund Policy. Eligible return requests must be submitted within the stated return window and must follow the authorization process. Catacysm does not currently process direct exchanges; where eligible, a customer may return an item and place a new order.
9. Acceptable Use
You may use the Site only for lawful personal shopping and related purposes. You may not:
- use the Site or products for unlawful or fraudulent activity;
- impersonate another person or provide materially false order, payment, or account information;
- interfere with Site security, availability, checkout, or other users;
- introduce malware, malicious code, or harmful automated requests;
- scrape, copy, or extract Site content or customer information through unauthorized automated means;
- attempt to gain unauthorized access to an account, system, or data;
- infringe intellectual property, privacy, publicity, or other legal rights; or
- use the Site to send spam, threats, unlawful harassment, or unlawful discriminatory content.
We may suspend access reasonably necessary to protect customers, the Site, or our legal rights. Enforcement of this section does not restrict a customer's right to communicate an honest opinion or review.
10. Intellectual Property
The Site and its original text, graphics, layout, photographs, logos, product presentation, and other content are owned by Catacysm or used with permission and are protected by applicable intellectual-property laws. You may view and use Site content for personal, noncommercial shopping purposes. You may not reproduce, distribute, sell, modify, or commercially exploit Site content without prior written permission from the applicable rights holder.
Product names, trademarks, images, or materials owned by third parties remain the property of their respective owners. No license is granted except the limited right to use the Site under these Terms.
11. Customer Feedback and Honest Reviews
Catacysm respects customers' right to share honest opinions about our products, services, and conduct, including negative opinions. Nothing in these Terms prohibits, restricts, or penalizes an honest review, and we do not require customers to transfer ownership of their reviews to Catacysm.
You remain responsible for content you submit and must not knowingly post false statements of fact, impersonate another person, disclose another person's private information without permission, infringe intellectual property, or submit threats, unlawful harassment, spam, or malicious code.
If you voluntarily submit content through a Site feature intended for publication, you retain ownership and grant Catacysm a limited, non-exclusive, royalty-free license to host, reproduce, and display that content for operating the Site and presenting the submission. This license does not prevent you from using your own content elsewhere and does not give Catacysm ownership of your review. We may remove content only when we reasonably believe removal is permitted by applicable law or necessary to address unlawful content, private information, intellectual-property infringement, threats, harassment, spam, irrelevance, or technical abuse.
12. Privacy
Our collection and use of personal information are described in our Privacy Policy. The Privacy Policy is separate from these Terms and does not create rights beyond those provided by applicable law or an express agreement.
13. Third-Party Services and Links
The Site may use or link to third-party services, including payment, shipping, tracking, analytics, advertising, or other service providers. Third parties operate under their own terms and privacy practices. Catacysm is not responsible for an unaffiliated third-party website or service, except to the extent responsibility cannot be excluded under applicable law. A link does not imply endorsement or affiliation.
14. Site Availability and Corrections
We may maintain, update, restrict, or discontinue Site features when reasonably necessary. We do not promise that the Site will always be uninterrupted or error-free. We may correct typographical, technical, pricing, availability, or other errors. Any correction affecting an existing order will be handled as described in Section 5 and in accordance with applicable law.
15. Disclaimer of Warranties
To the maximum extent permitted by law, the Site and general informational content are provided on an "as is" and "as available" basis. We do not warrant that access will be uninterrupted or that every Site error will be corrected immediately.
This disclaimer does not exclude any express product commitment made by Catacysm, any remedy stated in our Shipping Policy or Return & Refund Policy, or any implied warranty or consumer right that cannot lawfully be excluded.
16. Limitation of Liability
To the maximum extent permitted by law, Catacysm and ARIANNY LOPEZ PENA will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Site when those damages were not reasonably foreseeable. For a claim relating to a purchased product, our total liability will not exceed the amount paid for the product giving rise to the claim, except where a greater remedy is required by law.
These limitations do not apply to liability that cannot legally be limited or excluded, including liability for fraud, willful misconduct, gross negligence, or personal injury caused by negligence where applicable law prohibits exclusion. Some states do not allow certain warranty exclusions or limitations, so parts of this section may not apply to you.
17. Indemnification for Unlawful or Commercial Misuse
To the extent permitted by law, you agree to be responsible for third-party claims, losses, or reasonable costs directly caused by your unlawful commercial misuse of the Site, malicious interference with Site security, or content you submit that infringes another person's rights. This section does not apply to an ordinary consumer purchase, an honest review, or a claim caused by Catacysm's own negligence or unlawful conduct.
18. Events Outside Reasonable Control
Catacysm is not responsible for delay or failure caused by events outside our reasonable control, such as severe weather, natural disasters, carrier disruptions, labor disputes, government action, widespread telecommunications failures, or other comparable events. We will use reasonable efforts to communicate material effects and fulfill or resolve affected orders. This section does not remove refund or cancellation rights required by law.
19. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law principles. Any dispute may be brought in a state or federal court with lawful jurisdiction in or serving Volusia County, Florida, unless applicable consumer law permits or requires another location. Nothing in this section prevents either party from bringing an eligible claim in small-claims court or exercising a non-waivable statutory right.
Before filing a claim, we encourage you to contact info@catacysm.com so that we can try to resolve the issue informally. Informal contact is encouraged but does not shorten a legal filing period or waive either party's rights.
20. Suspension and Termination
You may stop using the Site at any time. We may suspend or terminate access when reasonably necessary because of fraud, unlawful activity, security abuse, or a material violation of these Terms. Termination does not cancel payment obligations for accepted and fulfilled orders or rights and obligations that by their nature should survive, including provisions concerning intellectual property, disputes, and liability. Orders already placed remain subject to applicable cancellation, shipping, return, and refund rights.
21. Severability, Waiver, and Assignment
If a provision of these Terms is held unlawful or unenforceable, it will be limited or severed only to the extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.
You may not assign an order or your rights under these Terms in a way that interferes with payment, delivery, fraud prevention, or another person's rights. Catacysm may transfer these Terms as part of a lawful transfer of the store or its assets, subject to applicable law and the protection of existing consumer rights.
22. Entire Agreement and Related Policies
These Terms, the order confirmation, applicable product-page disclosures, and the policies linked below form the agreement governing your purchase and use of the Site:
A product-specific or checkout disclosure controls for the particular product or transaction it expressly addresses. The Shipping Policy and Return & Refund Policy control for their respective subjects. These Terms control general Site use and other matters.
23. Changes to These Terms
We may update these Terms by posting the revised version on this page with a new "Last Updated" date. Changes apply prospectively from the posted effective date. An update will not retroactively reduce rights attached to an order already accepted unless required by law or agreed by the customer. If you continue using the Site after revised Terms take effect, the revised Terms apply to that later use.
