Catacysm is operated by ARIANNY LOPEZ PENA as a sole proprietor (referred to in this Privacy Policy as "Catacysm," "we," "us," or "our"). Catacysm is an independently operated online formalwear store serving customers in the United States. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit Catacysm.com (the "Site"), place an order, contact customer service, or otherwise interact with us.
This Policy applies to the Catacysm website and our U.S. online retail operations. Catacysm currently sells and ships products only within the United States.
1. Personal Information We Collect
The information we collect depends on how you use the Site and may include the following categories:
- Contact and identity information: name, email address, telephone number, billing address, shipping address, and other information you provide at checkout or when contacting us.
- Order and transaction information: products viewed or purchased, size and product selections, order number, order status, purchase amount, discounts, taxes, shipping and tracking information, returns, refunds, cancellations, and communications about an order.
- Payment-related information: the payment method selected, billing details, transaction status, and limited payment information made available to us by the payment processor. Full payment-card numbers and card security codes are processed by the payment service available at checkout and are not directly stored by Catacysm.
- Customer-service information: messages, photographs or other documentation voluntarily submitted in connection with fit questions, order issues, returns, damaged items, lost packages, or other support requests.
- Device and usage information: IP address, browser type, device type, operating system, referring pages, pages viewed, approximate location derived from IP address, date and time of access, and information about interactions with the Site.
- Marketing preferences: your email-marketing selection at checkout, unsubscribe status, and related communication preferences.
Please provide only information that is reasonably necessary for your order or request. If you provide information about another person, such as a gift recipient or authorized pickup contact, you are responsible for having permission to provide that information.
2. How We Collect Information
We collect personal information:
- Directly from you when you browse the Site, place an order, request a return or refund, subscribe to marketing emails, or contact us.
- Automatically through cookies, server logs, and similar technologies when you use the Site.
- From service providers that help operate the store, process payments, prevent fraud, fulfill and track shipments, provide customer communications, or measure Site performance.
3. How We Use Personal Information
We may use personal information to:
- operate, maintain, and improve the Site;
- process and confirm orders, payments, shipping, tracking, delivery, returns, exchanges, refunds, and cancellations;
- verify order details and communicate about product availability, custom or preorder processing, delivery, or service issues;
- respond to questions and provide customer support;
- detect, investigate, and help prevent fraud, abuse, security incidents, or violations of our Terms of Service;
- maintain business, tax, accounting, warranty, dispute, and compliance records;
- analyze Site performance and understand how visitors use the Site; and
- send marketing emails in accordance with the preference presented to you and applicable law.
4. Marketing Emails and the Checkout Preference
At checkout, the option to receive marketing emails may be selected by default. You may clear that selection before submitting your order. If you receive marketing emails, you may unsubscribe at any time by using the unsubscribe link in the message or by contacting us at info@catacysm.com. We will process unsubscribe requests as required by applicable law.
Order confirmations, shipping notices, return or refund updates, fraud-prevention messages, and responses to customer-service requests are transactional or service communications, not marketing. You may continue to receive these messages when they are necessary to complete or support a transaction even if you unsubscribe from marketing emails.
5. Cookies and Similar Technologies
The Site uses cookies and similar technologies to operate essential storefront functions, remember settings, maintain shopping-cart and checkout functions, protect the Site, and understand Site performance. Depending on the services enabled in the store, these technologies may include:
- Necessary technologies used for security, navigation, shopping-cart, checkout, account, and order functions;
- Preference technologies that remember choices and improve usability;
- Measurement technologies that help us understand traffic and Site performance; and
- Advertising technologies that, when enabled, may help measure advertising results or provide more relevant advertising.
You can use your browser settings to block or delete cookies. Blocking necessary cookies may prevent parts of the Site, cart, or checkout from working correctly. Where the Site provides an additional cookie or privacy-choice control, you may also use that control. The exact cookies used can change when store settings or service providers are updated; this Policy describes the purposes for which those technologies may be used and will be updated if our practices materially change.
6. Google Analytics and Google Ads
Catacysm uses Google Analytics to understand Site traffic and performance, including information such as session activity, pages viewed, approximate location derived from IP address, and browser and device information. Google Analytics may use cookies or similar identifiers, including a client identifier, to distinguish visits and produce measurement reports.
Catacysm also uses Google Ads to advertise products and measure advertising performance and conversions. When Google services are used on the Site, your browser may send Google information such as the page URL, IP address, device or browser information, and interactions connected with an advertisement or Site visit. Google may set or read cookies for measurement, fraud prevention, advertising, andâdepending on your settings and applicable choicesâad personalization.
Google processes information under its own terms and privacy practices. You can learn more at How Google uses information from sites or apps that use its services. You may manage Google advertising preferences through Google My Ad Center and may use the Google Analytics Opt-out Browser Add-on. Browser and Site cookie controls may also affect how these technologies operate.
7. How We Disclose Personal Information
We may disclose personal information only as reasonably necessary for the purposes described in this Policy, including to:
- E-commerce and hosting providers that operate the storefront, customer-account, cart, checkout, order-management, and related infrastructure;
- Payment processors and financial institutions that authorize and process payments, refunds, and fraud checks;
- Shipping and tracking providers, including UPS, to prepare, ship, track, and deliver orders and investigate delivery issues;
- Customer-service, email, and communications providers that help send order, service, and marketing messages;
- Google, including Google Analytics and Google Ads, for Site measurement, advertising, conversion reporting, fraud prevention, and related services described above;
- Other security and fraud-prevention providers when needed to protect the Site, customers, and transactions;
- Professional advisers such as accountants, insurers, or legal advisers when reasonably necessary; and
- Government authorities or other parties when required by law, legal process, or a valid request, or when reasonably necessary to protect rights, safety, property, customers, or the Site.
If the store or substantially all of its assets is involved in a sale, reorganization, financing, or transfer, personal information may be disclosed as part of that transaction, subject to appropriate safeguards and applicable law.
Catacysm does not sell personal information for money. Some U.S. state privacy laws may define certain advertising-related disclosures as a "sale," "sharing," or "targeted advertising" even when no money is exchanged. If Catacysm uses technology covered by those definitions and the applicable law grants you an opt-out right, you may submit a request using the contact details below.
8. Payment Information
Payments are processed through the payment service made available at checkout. The payment processor collects and uses payment details under its own privacy notice and security practices. Catacysm receives transaction confirmation and information needed to manage the order, but does not directly store your full payment-card number or card security code.
9. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including fulfilling orders, providing customer service, maintaining tax and accounting records, preventing fraud, resolving disputes, enforcing agreements, and complying with legal obligations. Retention periods vary based on the type of information, the reason it was collected, and applicable legal requirements. When information is no longer reasonably needed, we may delete, anonymize, or securely dispose of it.
10. Data Security
We use reasonable administrative, technical, and organizational safeguards appropriate to the nature of the information and the size of our operations. We also rely on service providers that maintain safeguards for the systems they operate. No website, transmission, or storage system can be guaranteed to be completely secure, so we cannot promise absolute security. You are responsible for keeping any customer-account credentials confidential and for notifying us if you suspect unauthorized use.
11. Processing by Service Providers
Catacysm is operated from the United States and serves the U.S. market. Some service providers may process or store information in the United States or other locations where they operate. When we use a service provider, we disclose information only for legitimate business purposes described in this Policy and expect the provider to handle it in accordance with its contractual and legal obligations.
12. Your Privacy Choices and Rights
You may:
- unsubscribe from marketing emails using the link in any marketing message;
- change browser cookie settings or use any privacy-choice control displayed on the Site;
- contact us to ask a privacy question or request access, correction, deletion, or a copy of personal information associated with you.
Depending on your state of residence and whether the relevant law applies to Catacysm, you may have additional rights, such as the right to know or access personal information, correct inaccurate information, delete information subject to exceptions, obtain a portable copy, or opt out of certain sales, sharing, profiling, or targeted advertising. You may also have the right not to receive discriminatory treatment for exercising an applicable privacy right.
To submit a request, email info@catacysm.com with the subject line "Privacy Request." Describe the request and provide the name and email address associated with your interaction or order. We may take reasonable steps to verify your identity before completing a request. We may deny or limit a request where permitted by law, including when information must be retained to complete a transaction, prevent fraud, comply with law, protect legal rights, or when we cannot reasonably verify the requester. An authorized agent may submit a request where permitted by applicable law, subject to verification of the agent's authority and the consumer's identity.
These rights are offered where required by applicable law. This section does not claim that every state privacy law applies to Catacysm.
13. Children's Privacy
The Site is intended for a general adult audience and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided personal information through the Site, contact us so that we can review and, where appropriate, delete it.
14. Third-Party Links
The Site may link to websites or services operated by third parties. Their privacy practices are governed by their own notices, not this Policy. We encourage you to review the privacy notice of any third-party service you use.
15. Changes to This Privacy Policy
We may update this Policy to reflect changes in our practices, services, technology, or legal obligations. The revised version will be posted on this page with a new "Last Updated" date. If a change is material, we may provide additional notice when required by law.
